1. What a founding place is

A founding place is an arrangement between your shop and Bexus Systems to use Bexus Booking for real bookings, at no charge, while the product is still being built — in exchange for telling us honestly how it is working.

It is not a purchase, a subscription or a trial that converts into one. These terms sit on top of the terms of service and take precedence where the two differ.

2. How a place is arranged

• You apply. Applying creates no account, no shop and no obligation on either side.
• We talk, and either of us may decide it is not a fit. We will say so plainly.
• If it goes ahead we send you an invitation code, set your shop up with you, and you go live when you say so — not before.

3. What it costs

Nothing. There is no monthly fee, no per-booking fee, no setup fee and no payment method held. The figures on the pricing page are illustrations of what pricing might eventually look like; they are not offers, nothing bills them, and none of them is a commitment by either of us.

If charging ever begins, it will be agreed with you in writing beforehand and you will be free to decline and stop.

That promise is now built into the software, not just written here. Bexus Booking records your free period and can see when it ends, but nothing in it can move you onto a paid arrangement, raise a charge or take a payment — there is no payment processing in the product at all. Paid service begins only when somebody at Bexus records a payment we have actually received, against an agreement you have already made.

4. What we ask of you

• Use it for real bookings. A founding place tested with fake appointments teaches nobody anything.
• Tell us when something is wrong, awkward or missing, in your own words.
• Give us a reasonable chance to fix a problem before deciding the product cannot do something.

We will not quote you, name your shop or use your logo in anything public without asking you first, each time.

5. What we do not promise

• That everything works. The features page says what is built. We go through the gaps with you before you decide, and we will not describe something as working when it is not.
• Uninterrupted availability. There is no service level agreement. Keep whatever fallback you use today for taking a booking when a system is unavailable.
• That the product will continue. If Bexus Booking is discontinued we will tell you as early as we can, give you your data in a readable form, and help you move.
• A price, a feature or a date. Nothing said during a founding place is a commitment about any of the three unless it is put in writing as one.

6. Your data and your customers

Your diary is yours. You are the controller of your customers’ data and we are your processor — see the data processing agreement. You can download your customers, your round and your bookings as spreadsheets from your own Plan and billing screen whenever you like, without asking us and without charge — and those downloads keep working if the account is ever suspended or closed.

Being on a founding place does not give us any wider use of your data than the agreement allows. In particular it does not let us market to your customers, and it does not let us use their details for anything of our own.

If you bring an existing round with you, the import asks you to confirm that these are your customers and that you may hold their details, and records which wording you confirmed. That is a record of your instruction to us, not a transfer of the responsibility to you — it stays yours either way, because they are your customers. An import can be undone while nothing has been done with it, and it refuses once there are visits, accepted enquiries or customer sign-ins sitting on top of it.

7. Ending it

• You, at any time, for any reason. Tell us and we will hand your data over. If you would rather stop taking new bookings first, taking your page offline does that immediately without cancelling anything already booked.
• Us, with reasonable notice. Except where the terms of service have been seriously misused, we will give you enough notice to move, and long enough to see out the appointments already in your diary.

Ending a founding place is not a breach by either side and neither owes the other anything for it.

8. If a founding place ends and you want to carry on

We will tell you what continuing would cost before you have to decide, and give you a reasonable period to decide in. You will never be moved onto a paid arrangement automatically.

What happens if a free period simply runs out is therefore the opposite of a bill. For a fortnight afterwards everything carries on working exactly as before. After that the account is suspended: your booking page stops taking new bookings and says only that it is temporarily unavailable, while you keep signing in, keep seeing everything, and keep being able to download all of it. You owe nothing for any of that, because nothing was ever charged.

Your own Plan and billing screen shows the dates, and we would rather have the conversation before any of it happens.
